Jeg har modtaget nedenstående email plus en lignende fra microsoft ang. en keygen.

Jeg kunne godt tænke mig at høre fra andre der har modtaget den samme eller lignende mails fra deres ISP.

Er der sket noget videre?
Hvad er sandsynligheden for at andre (fx APG) også har snaget og måske fået min filelist?
Hvor længe vil der i så fald gå før jeg hører fra dem (brev eller optrappen hos mig)?

Normalt er jeg kun på private DC hubs, men i dette tilfælde havde jeg rodet mig ud på en public (havde et reg så jeg anede det sgu ikke... sur røv)

Hvis der er dig nogen trøst, så har jeg også fået sådan en. Du står ikke alene. I mit tilfælde var det en "compliance manager" hos et californisk advokatfirma som af en eller anden uransagelig årsag havde fået den opfattelse, at en eller anden med mit IP har hentet Hellboy via Bittorrent. Når jeg finder ud af, hvem der har misbrugt min adresse til sådan noget ulovlig noget, så vanker der!

De henvendelser I har modtaget, er afsendt af robotter som udelukkende scanner efter filnavn.efternavn.

Det betyder, at der ikke findes nogle former for beviser til at bakke deres anklager op. Ingen stikprøver af hvorvidt indholdet af filen stemmer overens med det påståede indhold (f.eks. Hellboy) og formentligt hverken screenshots eller en reel efterforskning overhovedet.

Min opfordring er soleklar:

1) Overvej hvorfor du har haft downloadet eller uploadet en fil kaldet "hellboy.avi" - er du selv filmmager? Er der tale om en shareware som deler navn med en kommerciel film? Noget helt tredie?

2) Sørg for at der ikke (ved et uheld) ligger ophavsrettighedsbeskyttet materiale på din computer

3) Send et klagebrev til afsenderen, afsenderens overordnede, afsenderens samarbejdspartnere, pressen og ikke mindst tag kontakt til en advokat om mulighederne for at søge erstatning eller indklage afsenderen for en eller anden instans som kan straffe afsenderen.

Men det er jo heller ikke mig, der har modtaget brevet...

De der breve som folk får fra CC er helt harmløse. En af mine venner som sidder på 26mbit i KBH fik flere breve fra CC om at han havde en film liggende som de ikke mente han skulle have. Han ringede derefter til CC og hørte hvordan han skulle forholde sig til det. Supporteren sagde ordret i telefonen: "Det skal du squ ikk tage dig af, dem får vi hele tiden, og vi ved jo godt hvorfor folk vil have bredbånd" :)

Som du kan læse flere steder, er det fuldautomatiske systemer der foretager "en konstant patruljering af P2P-netværkene efter rettigheds-krænkere", som et af firmaerne bag disse systemer skriver.

Og angiveligt er softwaren ikke 100% fejlfri, for det er ikke første gang jeg hører om folk som har fået breve vedrørende ting de aldrig har hentet eller tjenester de aldrig har brugt.

Men selv i USA bruges materiale af denne art ikke som basis for sagsanlæg eller anmeldelse - deres formål er ene og alene at skræmme...

... så derfor er kravene til korrekthed og integritet af materialet ikke så store. Det gælder bare om at få fyret en masse mails afsted.

Det kan vel ikke være meningen, at de uden grund skal kunne beskylde alle for hvad som helst.
